1. Scope and contracting parties
These General Terms and Conditions apply to contracts for goods and services between

– hereinafter referred to as “HIDALGO” – and its customers.
The HIDALGO website serves in particular to provide information about and present the products and services offered. Contracts are not concluded directly through an online shop on the website.
These Terms apply to consumers and business customers alike, unless individual provisions expressly state otherwise. Mandatory statutory consumer rights remain unaffected.
2. Offers and conclusion of contract
The presentation and description of products and services on the website, on social media, in brochures or other information material does not generally constitute a binding offer.
Orders and individual enquiries may be placed by e-mail, telephone, WhatsApp or other means of communication.
A contract is concluded when HIDALGO accepts the order or issues a corresponding order confirmation. For individually configured saddles and custom-made products, the order or configuration confirmed by the customer is decisive.
3. Prices and payment
The prices agreed in the respective offer or upon conclusion of the contract apply.
For consumers, stated final prices include statutory value added tax unless expressly indicated otherwise. Shipping costs and any further charges are stated in the respective offer or communicated before the contract is concluded.
Unless agreed otherwise, the agreed purchase price is due in full before the goods are dispatched or handed over.
4. Delivery and delivery times
Products in stock are dispatched after receipt of payment or in accordance with the individual arrangement made.
For custom-made and individually ordered products, expected production and delivery times are stated in the respective offer or when the order is placed.
HIDALGO products are in part made individually and by hand. Stated production and delivery times are therefore non-binding estimates unless a binding delivery date has been expressly agreed. Statutory customer rights in the event of delayed delivery remain unaffected.
5. Custom-made products and special orders
HIDALGO offers a wide range of individually configurable saddles and other products. Individual specifications may relate in particular to seat size, saddle flap, type and colour of leather, panel shape and length, girthing, fittings, stitching and further features.
The customer is obliged to check the agreed order and configuration details carefully before final approval.
For goods made to customer specification or clearly tailored to the customer’s personal requirements, the statutory right of withdrawal for distance contracts may be excluded. Statutory rights in the event of defective goods or goods deviating from the agreed condition remain unaffected.
6. Trial service
HIDALGO offers a trial service for selected saddles and products. The trial period, trial fee, any required deposit and the shipping and return conditions are agreed individually or communicated to the customer before the trial begins.
Trial products remain the property of Dr. Nina Holzer GmbH throughout the entire trial period. The customer undertakes to handle the trial goods with care and in an appropriate manner.
Normal signs of use arising from intended trial use are not generally regarded as damage. Statutory provisions apply to damage, loss or alterations that go beyond proper trial use.
If the trial goods are not purchased, they must be returned in full, including any accessories provided, after the agreed trial period has ended.
7. Saddle fitting and consultation
HIDALGO offers consultation and fitting services both in person and on the basis of photographs, videos, measurements and other information provided by the customer.
The customer is responsible for providing the information, measurements, photographs and videos required for the consultation as completely and accurately as possible.
A saddle fit is assessed on the basis of the condition of horse, saddle and rider at the time of the consultation. Horses can change through training, growth, age, changes in weight, musculature, illness or other factors. A fitting once carried out can therefore not guarantee a permanently unchanged fit.
The customer is responsible for checking the fit regularly and for having it re-checked if changes occur.
8. Distance selling and right of withdrawal for consumers
Where a contract is concluded with a consumer exclusively by means of distance communication and the statutory requirements for a distance contract are met, the statutory provisions apply.
The statutory withdrawal period is generally 14 days from the point in time determined by law. Where required by law, the consumer will receive the corresponding withdrawal instructions and the model withdrawal form separately.
For goods made to customer specification or clearly tailored to the customer’s personal requirements, the statutory right of withdrawal may be excluded.
9. Returns
For returns, we kindly ask you to contact HIDALGO in advance so that the shipment can be allocated quickly and clearly. For consumers, such prior contact is not a prerequisite for exercising statutory rights.
The costs and handling of a return are governed by the respective contractual agreement and by mandatory statutory provisions.
10. Retention of title
The goods remain the property of Dr. Nina Holzer GmbH until the agreed purchase price has been paid in full. Trial products remain the property of Dr. Nina Holzer GmbH until an expressly agreed purchase has been made and paid for in full.
11. Warranty
The statutory warranty provisions apply. A voluntary guarantee exists only where it has been expressly granted for the product concerned.
The statutory warranty does not cover damage that occurs after handover as a result of ordinary wear and tear, improper use, insufficient care or unauthorised modification. Mandatory statutory consumer rights remain unaffected.
12. Leather, natural materials and craftsmanship
HIDALGO saddles and other products are made to a considerable extent from leather and other natural materials and are produced by hand.
Natural leather may vary in colour, grain, texture and surface finish. Slight variations may likewise occur in hand-crafted products.
Such variations, typical of natural materials and craftsmanship, do not constitute a defect provided they do not impair the agreed function and ordinary use of the product.
13. Safety and use
Saddles and riding equipment must be checked regularly, and in particular before use, to ensure they are in proper condition. This applies especially to safety-relevant components such as girth straps, stirrup bars, straps, stitching and connecting elements.
Products with visible safety-relevant damage must not continue to be used until they have been professionally inspected or repaired.
14. Liability
The liability of Dr. Nina Holzer GmbH is governed by statutory provisions. Mandatory statutory liability claims, in particular towards consumers, are not restricted by these Terms.
In accordance with statutory provisions, HIDALGO is not liable for damage caused exclusively by improper use, unauthorised modification or continued use despite recognisable damage.
15. Business customers and distribution partners
For contracts with business customers, statutory commercial law provisions apply in addition. Separate dealer, distribution, cooperation or other individual agreements take precedence over these Terms.
16. Data protection
Personal data is processed in accordance with the applicable data protection provisions. Further information can be found in the separate privacy policy on the HIDALGO website.
17. Applicable law
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods, to the extent legally permissible.
For consumers, this choice of law does not affect those mandatory consumer protection provisions of the state of their habitual residence which cannot be excluded by a choice of law.
18. Place of jurisdiction
For contracts with business customers, the court having subject-matter jurisdiction at the registered office of Dr. Nina Holzer GmbH is agreed to have jurisdiction, to the extent legally permissible. For consumers, the statutory rules on jurisdiction apply.
19. Final provisions
Individual agreements between HIDALGO and the customer take precedence over these General Terms and Conditions.
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected to the extent permitted by law.
